Eforms are coming back!
The ATF is still working at it. Now, along with a form 6 and form 1, the form 2 is also available through the eforms website. It is not a form 4, but we are getting closer. Next up, we anticipate form 3s, then perhaps the form 4.
It looks like the ATF is serious about this too. They are holding a meeting this week at ATF Headquarters in Washington DC to discuss how to make the eforms work, and work efficiently. They have invited a select few people from across the country to participate in this meeting. We are monitoring this very closely and will update you with information as we receive it. For now, keep your fingers crossed.
The ATF announced today (June 24, 2014) that they are still working on the eforms upgrade. They opened up the eforms site to now allow form 1s as well as form 6s. While this is not great news, after all, we are waiting for the Form 3s and 4s to come back online, it shows that they are working on it and moving in the right direction.
However, some other good news came out of this announcement. From a peak of over 81,000 pending NFA applications at the end of February 2014, as of June 18, 2014, ATF has reduced the number to less than 63,000 applications pending (23% reduction in pending applications). In the last four weeks, although the NFA Branch received over 17,800 applications they processed more than 22,400 applications. Please keep in mind that this is pending applications. What this means is they are processing more than are coming in. THIS IS GOOD!
The ATF has also hired more people to process the applications and are in the process of hiring 15 more examiners (people to process the applications). Reportedly, they have authorized overtime to process the applications and to reduce the backlog. Is this being run by our current administration??? The naysayers will swear that anything the current administration is doing is designed at making obtaining NFA items harder. At least reportedly, this is a step in the right direction and it is supported by the numbers. Again, reportedly.
For now, we all will keep our fingers crossed in hope of reasonable processing times.

ATF eForms site came back online tonight! However, it is only there partially. They announced today that they are starting with Form 6, and will be adding forms as adjustments are made. They anticipate to have the Form 4s up and operating shortly. The following is on the eForm site:
"During the next few weeks as the eForms is enhanced, ATF anticipates that the eForms system will accept processing of Forms 6 and 6A initially, followed by forms 1, 2, 5, 9, 5300.11 and 10. Paper applications via any form will continue to be processed, and Forms 3 and 4 will be prioritized. We expect Forms 3 and 4 to return to eForms very soon, as the enhancements are completed."

On Friday, April 4, 2014, the ATF took the E-Forms system offline. Reportedly, the original message took the site offline indefinitely. To the extent that is true the current message is not so ominous. As it sits now it reads as follows:

Due to maintenance, the eForms system is unavailable. We apologize for any inconvenience and thank you in advance for your cooperation and patience.
In the interim, all imports forms (Forms 6 Part I and 6A), NFA forms (1, 2, 3, 4, 5, 9 and 10), and AFMER reports (Form 5300.11) must be submitted via paper, including any eForms in draft status.

We are still investigating to find out what this means and if the eforms will be coming back online anytime soon. We will update you as we know more.
After a long wait, it finally passed. On February 11, Governor Nikki Haley (R) signed into law, Senate Bill 308, which allows Concealed Weapons Permit (CWP) holders to carry a concealed weapon in establishments that serve alcohol, so long as the person is not drinking. Carrying and drinking is still illegal. The bill actually modifies the existing law, but the result is the same.
In addition, the bill also has the effect of extending the duration or length of term of the CWP, improving training standards, improving the application and renewal process and expanding where a CWP holder may transport a firearm in his or her motor vehicle.
Governor Haley spoke at length during the signing ceremony about the importance of removing the restriction on CWP holders carrying for personal protection in restaurants where alcohol is served. Its great to see our own state pushing back to paranoid extreme states such as Connecticut and California.
